Information additionnelle
The records in this accession, with the exception of a few files in box #273 which are in the form of controversial immigration case files, are part of the Headquarters case file series. This series was developed in 1946 and has been used by the Immigration program to capture information on individual immigrants. These Headquarters case files document individuals who were issued deportation notices after they were found guilty of violating Section 19 of the Immigration Act. This section of the Act stipulates that any individual who possesses severe health or mental problems, are unable to support themselves, or have committed a crime that may be punishable under an Act of Parliament, should be denied admission to Canada. A large percentage of the deportation cases are appealed to the Immigration Appeal Board or its successor, the Immigration and Refugee Board. A small number of cases are successfully appealed to the Federal Court, and in rare circumstances, the Supreme Court of Canada.
These deportation case files are from the Fourth and Fifth Headquarters Series. The files contain the following types of documentation: Correspondence, internal memoranda, minutes of inquiry, transcripts from inquiries, detainee expense sheets, telegrams, warrants of arrest, deportation orders, and occassionally, reports by the RCMP and/or local police. Some of the files also contain information from the Immigration Appeal Board hearings. The documents from these hearing would consist of notices of appeal, appeal reviews and exhibits, and the Immigration Appeal Board decisions. Those cases that were heard by the Federal or Supreme Court would contain decisions from those tribunals.
